WE AT LABENA VENTURES RESPECT YOUR PRIVACY AND ARE COMMITTED TO PROTECTING YOUR PERSONAL DATA (OR “INFORMATION ABOUT YOU” WHICH HAS IN THIS NOTICE THE SAME MEANING AS PERSONAL DATA).
THIS NOTICE WILL INFORM YOU AS TO HOW WE LOOK AFTER YOUR PERSONAL DATA WHEN YOU APPLY FOR LABENA VENTURES PROGRAM AND TELL YOU ABOUT YOUR PRIVACY RIGHTS AND HOW THE LAW PROTECTS YOU.
PLEASE READ THIS NOTICE CAREFULLY BEFORE APPLYING INTO LABENA VENTURES PROGRAM AND LET US KNOW IF YOU HAVE ANY QUESTIONS OR OTHER FEEDBACK REGARDING IT.

1.    WHO IS RESPONSIBLE FOR COLLECTION AND USE OF YOUR PERSONAL DATA?

1.1    LABENA VENTURES is the Data Controller and thus responsible for the collection and use of information about you.

2.    WHAT DOES THIS NOTICE COVER?

2.1    This Notice covers information about you that we collect when:

(a)    you apply for the Labena Ventures acceleration program (“Labena Ventures Program”),

(b)    you sign up or participate in an event or presentation as part of the Labena Ventures Program,

(c)    you subscribe to our newsletter,

(d)    you communicate with us.

3.    WHAT TYPE OF INFORMATION DO WE COLLECT ABOUT YOU?

3.1    We may collect and process the following information about you:


(a)    Identity Data includes first name and last name.


(b)    Contact Data includes email address and telephone numbers.


(c)    Application Data includes Identity Data, Contact Data, education, employment history and the city/country you live, as well as information about your company (together with the Personal Data relating to founder(s). We may also record interviews with founder(s) and the content, recordings and information contained in such recordings are part of the Application Data governed by this Notice.


(d)    Event Data includes Identity Data, Contact Data, LinkedIn profile, interest-based data, the name and description of your company and other information that we will use to manage, optimize and administer your participation at or during our various events. We may also photograph or videorecord the event and such recordings and/or photographs are part of the Event Data governed by this Notice.


(e)    Communication Data includes Identity Data, Contact Data and the contents of any messages you send.


(f)    Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access the apply form for Labena Ventures Program.

3.2    We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your Personal Data but is not considered Personal Data in law as this data will not directly or indirectly reveal your identity.
3.3    We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.
3.4    Where we need to collect Personal Data by law, or under the terms of a contract we have with you, and you fail to provide that information when requested, we may not be able to perform the contract we have or are trying to enter into with you.

4.    HOW DO WE COLLECT INFORMATION ABOUT YOU?

4.1    We use different methods to collect information about you:
(a)    Direct interactions. You may give us your Identity, Contact, Application, Event and Communication Data by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes Personal Data you provide when:
  •     you apply for participation in Labena Ventures Program via our website or third party websites or platforms, such as, but not limited to F6S;
  •     create an account on our website or via our website or third party websites or platforms, such as, but not limited to F6S;
  •     subscribe to our publications;
  •     enter an event or survey; or
  •     give us feedback or contact us.
(b)    Third parties or publicly available sources. We will receive Personal Data about you from various third parties and public sources as set out below:
  •     search information providers;
  •     Identity and Contact Data from publicly available sources such as AJPES, Zemljiška knjiga, LinkedIn, F6S etc.

5.    HOW DO WE USE INFORMATION ABOUT YOU (PURPOSES OF PROCESSING YOUR PERSONAL DATA)?

5.1    We may process information about you for several purposes:

(a)    To provide and administer access to the (application form for the) Labena Ventures Program.

(b)    To grant access to and track attendance at our events.

(c)    To inform you about services or events we believe might be of interest to you.

(d)    To administer promotions and surveys you choose to participate in, as required by applicable law (for example, to provide a winners list or make required filings), or in accordance with the rules of the promotion or survey.

(e)  To respond to your inquiries, comments, feedback, or questions.

(f)  To send administrative information to you, for example, information regarding the Labena Ventures Program and changes to our terms, conditions, and policies.

(g)  To analyse how you interact with our team at Labena Ventures Program.

(h)    To maintain and improve the content, organization and execution of Labena Ventures Program.

(i)    To develop new (acceleration) programs and services.

(j)    To prevent fraud, criminal activity, or misuses when participating in Labena Ventures Program, and to ensure the security of our IT systems, architecture, and networks.

(k)    To comply with legal obligations and legal process and to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other third parties.

6.    CHANGE OF PURPOSE

6.1    We will only use your Personal Data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose.
6.2    If we need to use your Personal Data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.
6.3    Please note that we may process your Personal Data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

7.    WHAT IS THE LEGAL BASIS OF PROCESSING INFORMATION ABOUT YOU?

7.1    We may process Personal Data relating to you if one of the following applies:

(a)    Consent. You have given your consent for one or more specific purposes. For example, when you give us your consent to photograph or videorecord you at our event.

(b)    Performance of an agreement. Provision of Data is necessary for the performance of an agreement with the you and/or for any pre-contractual obligations thereof. For example, when you enter into agreement for participation in the Labena Ventures Program with us.

(c)    Compliance with a legal obligation. Processing is necessary for compliance with a legal obligation to which we are subject. For example, if we would have to report any tax obligations to tax authority we are obligated to fulfil under the law if you were awarded a financial prize.

(d)    Public interest / official authority. Processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in us.

(e)    Legitimate interest. Processing is necessary for the purposes of the legitimate interests pursued by us or by a third party. For example, when we send you direct marketing messages as our existing client/business partner or to prevent frauds or improve our services.

7.2    Place. The Personal Data is processed at our operating offices and in any other places where the parties involved in the processing are located. Depending on your location, data transfers may involve transferring your Personal Data to a country other than your own.

8.    RETENTION TIME

8.1    Personal Data shall be processed and stored for as long as required by the purpose they have been collected for. Therefore:

(a)    Personal Data collected for purposes related to the performance of a contract between us and you shall be retained until such contract has been fully performed.
(b)    Personal Data collected for the purposes of our legitimate interests shall be retained as long as needed to fulfil such purposes.
(c)    We may be allowed to retain Personal Data for a longer period whenever you have given consent to such processing, as long as such consent is not withdrawn. Furthermore, we may be obliged to retain Personal Data for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.
(d)    Once the retention period expires, Personal Data shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

9.    YOUR RIGHTS

9.1    You may exercise certain rights regarding your Personal Data. In particular, you have the right to do the following:

(a)    Withdraw your consent at any time. You have the right to withdraw consent where you have previously given your consent to the processing of your Personal Data.

(b)    Object to processing of your Personal Data. You have the right to object to the processing of your Personal Data if the processing is carried out on a legal basis other than consent.

(c)    Access to your Personal Data. You have the right to learn if Personal Data is being processed by us, obtain disclosure regarding certain aspects of the processing, and obtain a copy of Personal Data undergoing processing.

(d)    Verify and seek rectification. You have the right to verify the accuracy of your Data and ask for it to be updated or corrected.

(e)    Restrict the processing of your Personal Data. You have the right, under certain circumstances, to restrict the processing of your Data. In this case, we will not process your Personal Data for any purpose other than storing it.

(f)    Have your Personal Data deleted or otherwise removed. You have the right, under certain circumstances, to obtain the erasure of your Personal Data.

(g)    Receive your Personal Data and have it transferred to another controller. You have the right to receive your Personal Data in a structured, commonly used and machine-readable format and, if technically feasible, to have it transmitted to another controller without any hindrance. This provision is applicable provided that Personal Data is processed by automated means and that the processing is based on your consent, on a contract which you are part of or on pre-contractual obligations thereof.

(h)    Lodge a complaint. You have the right to bring a claim before their competent data protection authority:

9.2    Details about the right to object to processing. Where Personal Data is processed for a public interest, in the exercise of an official authority vested in us or for the purposes of the legitimate interests pursued by us, you may object to such processing by providing a ground related to your particular situation to justify the objection. You must know that, however, should your Personal Data be processed for direct marketing purposes, you can object to that processing at any time without providing any justification.

9.3    How to exercise these rights. Any requests to exercise your rights can be directed to us through the contact details provided in this Notice. These requests can be exercised free of charge and will be addressed by us as early as possible and always within one month.

10.  ADDITIONAL INFORMATION ABOUT PERSONAL DATA COLLECTION AND PROCESSING

10.1    Security. We will use commercially reasonable efforts to safeguard the confidentiality of your Personal Data. However, we cannot be held liable for any loss of or disclosure of Personal Data or any losses or damages incurred due to errors in transmission or unauthorized or unlawful acts of third parties or your decision to disclose your Personal Data. No system can be 100% secure, and despite our efforts, there is always a risk of unauthorized access to your Data. By participating in Labena Ventures Program, you assume this risk.
10.2    Legal action. Your Personal Data may be used for legal purposes by us in court or in the stages leading to possible legal action arising from improper use of our services. You declare to be aware that we may be required to reveal Personal Data upon request of public authorities.

10.3    Information not contained in this Notice. More details concerning the collection or processing of Personal Data may be requested from us at any time. Please see the contact information at the beginning of this Notice.

10.4    Changes to this Notice. We reserve the right to make changes to this Notice at any time by notifying you on this website and/or – as far as technically and legally feasible – sending a notice to you via any contact information available to us. It is strongly recommended to check this website often, referring to the date of the last modification listed at the bottom. Should the changes affect processing activities performed on the basis of your consent, we shall collect new consent from you, where required.

10.5    Legal information. This Notice has been prepared based on provisions of multiple legislations, including Art. 13/14 of Regulation (EU) 2016/679 (General Data Protection Regulation). This Notice relates solely to execution of Labena Ventures Program, if not stated otherwise within this Notice.

10.6    Assuming responsibility. In the period between the publication of the tender/applications for Labena Ventures Program and establishment of Labena Ventures d.o.o. the latter, although not yet legally established, shall assume all responsibility and liability for all and any obligation under this Notice to the extent legally permissible. In the event that Labena Ventures d.o.o. is unable to assume such responsibility or act as the controller due to legal limitations or otherwise, Labena d.o.o., Verovškova ulica 64, 1000 Ljubljana, company number: 5699479000 shall assume liability for any obligations contained in this Notice. Upon the establishment of Labena Ventures d.o.o., it assumes full responsibility and is deemed the controller for the processing of Personal Data collected and processed through this website or other means.
